I believe you are thinking of yes to encompass non-verbal consent as well, while it seems that yes means yes law dictates that the sexual partner must verbally express just that, YES. Otherwise it still constitutes as rape. I'm sure you're aware that there is a "silent understanding" in lots of sexual activities.

Body language, chemistry, a look in the eye, etc. can all change an afternoon spent on the couch watching a movie, to kissing and then ***, without a "yes" ever being uttered. Though I suspect any person that interacts with humans on a regular basis can foresee the countless situations where *** without a "yes" doesn't equate to rape.

I believe this is what they mean when they say to you how easily it can be exploited.
