The term you two are looking for is NGRI (Not guilty by Reason of Insanity)...kind of an antiquated term now that I'm looking at it. One of my responsibilities is evaluating forensic clients (incarcerated people) for psychiatric hospitalization. You need a few other doctors to determine if the client has capacity to understand their actions and consequences. If they are deemed incompetent then they are tried again in a hearing (usually at the forensic state hospital) for NGRI. If the judge agrees with the psychiatrist/psychologists the client is labeled NGRI and time served in a psychiatric hospital equates to time served in a jail. The only caveat is that once you are deemed that incompetent your freedom is going to be severely limited for the rest of your life. Most of these people stay in forensic hospitals or group homes for violent offenders long after their time would have been served in prison. We also don't do NGRI very often anymore. I remember the movie, One Flew Over the Cuckoo's Nest. It doesn't really work that way anymore like it did in the 1960s.

One thing I see so often are people pretending to be psychotic to get out of jail time. It doesn't work. You get sent to the psychiatric hospital until you're healthy to return to your jail sentence. The time served in a psychiatric hospital does not count toward your sentence unless you are NGRI, so most of those people just extend the inevitable.
Thanks for the info, but basically Ldude also referred to the insanity plea, and I know about that, my pondering was not legal but rather psychological...I originally reflected on OP saying that it's determination that makes murderers take the step, but I think that to talk about determination, one at least should have the mental capacity to grasp cause-effect relation between his/her deeds and the possible results. But let's take f.e. children or retarded people playing video games, where the characters don't die. So they want to try playing it in real life too, with daddy's gun. In their head, shooting won't result in one's death. They simply couldn't see the consequence, so I don't think we can talk about determination here...

Anyway, I liked that movie too :p It's based on a novel. Dat native fellow was my fav. He pretended to be dumb for yrs...It was an interesting movie altogether. Some people in mental hospitals are indeed not any less normal/sane than the average passer-by on the street...Who knows, maybe you sit down on a bus next to a schizophrenic, who is totally harmless. And honestly, some 'normal' and even well-known people should be put in a mental hospital every now and then. F.e some politicians xd They're crazy...

And yeah, here the court can also send someone to a mental hospital for observation, (for a month, that can be extended), if the person might have a mental disorder. And if the person is diagnosed with e mental disorder, he/she won't be charged but will still be sent to a mental clinic, which is not much better than jail, and his/her legal capacity will be confined, and he/she'll be given a tutor who'll represent the person in his/her legal affairs.

Well, where I am NGRI is the insanity plea. Most of the people that try pulling it off are pre-sentenced, awaiting their actual trial and sentencing. They try smearing poop in their holding cell, or hanging themselves with a bed sheet while in solitary to get sent to psych hospital for NGRI evaluation. Our forensic state hospital is just as bad as jail. Each room is solitary and padded with a police officer between every two "rooms."

Yeah the beauty of One Flew Over a Cuckoos' Nest is how it captured the concept of Shared Psychosis (when I was a student it was called Folie à deux). He pretended to be mentally ill to get out of jail for petty theft, but ended up becoming mentally ill due to high exposure and incorporation of his environment into his self. Ken Kesey wrote it...he was one of the Beatnik writers that I grew up reading.

My Mother does not do drugs. My brother, Dylan, is involved in the drug business and perhaps he has partook in the use of this kush with Gunner, but he is the only one. My Mother and I do not use this kush. We don't have a problem with those who do, but we just don't.

I'm currently employed at a butcher shoppe, and I love my job. I start school in the Spring and I'll probably work here until I get my associates.

My current level of education is just a high school diploma.
