Also, unless a person actually makes the jutsu themselves, they learned it from a scroll or teacher. Madara was the first with MS and Susanoo, does that mean any one else who have them copied him? Hashirama's wood clones are Tobirama's shadow clone jutsu with wood chakra added and same for Itachi's water clone. Itachi didn't make all of the fire jutsus he used since we seen other Konoha ninjas used fire ball jutsu as well. You have to take Itachi out if you don't want someone with copied powers then since he, like all Uchihas learned from their elders.

Madara taught Uchiha Kinjutsus to Obito who taught Itachi (he called Madara (Tobi) his teacher).
