Tobi said that he would also have attacked the village if itachi hadn't agreed to kill of the clan members
He stated that he was planing on "re-kindling the flames of war in konoha".
so there would have been a war and Innocents killed regardless.

Agreed. I am not saying that he is "innocent", or even justified. Just that he was dealt a really shitty hand, and that he went with it the best way he could. I would probably have done the same thing in his situation, but you're right; he is STILL guilty for his actions.

He didn't actually the databook II states itachi and sasuke were the youngest members of the clan at the time of the massacre. itachi being 13 and sasuke being 7.
the only innocent child was sasuke who was spared, itachi even stated that he didn't kill him specifically because-

1. he was a child.
2.and he was innocent who didn't share the same idea as the rest of the fools in the clan
