Kabuto even tho he's not a formal member of the akatsuki, he's still the smartest person other than itachi, he's not following blindly he actually has a backup plan to get out or away from the group without complications

Orochimaru is the smartest and I'm being a fanboy when I say that. He's been the smartest while he was in the organization and out the organization. He knew about Madara and his secrets and planned ahead, whether it was working with others behind his back or trying to eliminate/capture tail-beast. All his strategies were on point, and he even took their spy (Kabuto).

That's a great point but wasn't Orochimaru outsmarted by Itachi on two occasions.
1. When Orochimaru tried to steal Itachi eyes he was already in Itachi's genjutsu.
2. When Orochimaru was drawn out in the Sasuke and Itachi fight wasn't he defeated by a sword that he was searching for his whole life.
DON'T UNDERESTIMATE AN UCHIHA!!!!!!!!

Tie between Madara (Mastermind above all else) and Kabuto (Suitable or maybe greater intelect then Madara) and second/Third is Itachi (not a mastermind but moderatly close to Madara and Kabuto).

I REALLY wanna say Itachi, but I'm pretty sure it's Madara.
Itachi is really smart, especially when it comes to strategies and fighting and can probably easily outsmart a lot of people (not everyone), but Madara is also smart and has had a plan for a LONG time now and it's still going. Sometimes I sometimes think that Madara already knw about Itachi and Sasuke (and many other people) before they were probabaly even born! O.O But yeah it's just MY opinion.

No one chose Konan except me? First of all, we do not know whether Tobi really is Madara yet. so that 50 year old plan could be the work of someone else claiming to be Madara. And Konan was really smart too. She surmised the best way to beat Tobi and almost did, the only reason she lost was because of Izinagi. Which she couldn't have known about. She almost did kill him. She forced him to use a forbidden technique that made him lose his eye. And she somehow figured out how long he could stay intangible, that he had to become tangible to attack. And used that information to set up a crazy technique that was nearly foolproof. Even I don't know how she found all that out, because it isn't as if she walked up to him, and lackadaisily chatted about that, and somehow weaned it out of him. She had to watch and analyze all his techniques, all his moves, and slowly try and theorize the best method of approach to kill him. To sum that up. Konan is smart
