Well in order to take his body orochimaru still has to beat him and then eat.

In order to take Itachi's body, he had to convince him or subdue him.

Orochimaru was weakened however and had no killing intent, also didn't have all of his kinjutsus then either.

Sasuke for instance won the fight against a weakened Orochimaru, later saying that he only won because Orochimaru was weakened.

There is no difference for Itachi.

depends how he went about things, knowing Orochimaru he probably tried his mind games. Nonetheless, we don't know what happened but it seems that Itachi did possibly fall into his dimension.
