I dont really know if he has EMs or not, but i have an argue if Madara uses Obito body.We know Oro uses bodies as hosts but he can only use it for 3 YEARS!!!!!Obito was crushed 16 years ago,so something different is happening

There Is No Disadvantage In That Technique..In Fact It Is An Advantage For The User..You Can Just Transfer Your Soul One To Another..I don't think madara used Oro's Fushi Tensei, the technique has lost of disadvantages, plus there are many other ways to be immortal (in the naruto world that is...) think about sasori, kakuzu , hidan!
Kakuzu Is Able To Extend His Life By Withdrawing The Hearts Of Their Opponents..The Hearts That He Contains Is His Weakness
Hidan Is Immortal Because Of His Jashin Ritual..He Can Live His Left Even He Was Torn To Pieces..Shikamaru Blows Him To Pieces And Trapped Him In The Land Of His Clan..Thats Why Shikamaru Rocks..XD
Sasori Is Not Immortal..He's Just A Puppet..And He Has This Chest Container That Contains His Life As His Weakness..

Madara its not using EMS, because probably it makes him use a lot
of chakra so, he just desactivates his EMS. It just that simple and about
the first and madara fight, he maybe didnt develop the time/space jutsu,
around that time, he still was a novice with his EMS he probably still
learning how to use to its potential.

there is a weakness orochimaru dosnt have the same physical abilities
of his original body, u only can use the body for 3 years until he starts
weakining, and its body is limited to the container potential so if
orochimaru take a common body of a shinobi it not going to have
the same potential like sasukes body.

Yeah..Thats Why I Had The Theory That Uchiha Madara Transferred To The Body Of Uchiha Obito By The Use Of That Kinjutsu Because Uchiha Obito Has The Uchiha Bloodline..He Weilds The Sharingan Too
