Who said you need to be Indra's reincarnation to get EMS? Pretty sure Itachi told Sasuke Uchiha killed their siblings regularly to get their vision back.

you got Itachi's statement twisted. What he said was that ppl attempting to get MS must kill his friend, and those who wanted to permanently wield it must kill his kin. It would've defeated the purpose of him mentioning Madara as being the first to unlock MS if others had done it before he was ever born.

fact is,only people we see having EMS are indra`s transmigrants so it`s safe to say only indra and his transmigrants can gain EMS

maybe uchihas having to transplant eyes and making their siblings a sacrifice symbolizes indra`s greed and absolute neccesity for power no matter what it costs

maybe indra`s transmigrants dont need sibling`s sharingan,maybe they can just gain EMS by transplanting any sharingan,who knows

or maybe indra`s spirit was waiting for such reincarnation where he would have a brother....it is known indra and ashura reincarnate in pairs at almost the same time so it is possible

To get EMS, you gotta be Indra's reincarnation and have a brother to take his eyes. SO what if Madara or Sasuke didn't have a brother? How would they reach their full potential?

That was never implied, but that is required for the Straight Commas that are exclusive to both Sasuke and Madara.
