Notice in the manga, he yells out whatever path he uses before he used it, there fore if I hit him with a jutsu before he can activate preta path, it is not absorbed.

True enough, but think about it, Naruto started a conversation with Deva path, destroyed it, and finished his conversation with Nagato, this means that when Jiraiya used his jutsu, Nagato heard it as well, yet only the bodies who physically heard the song ended up in the Genjutsu. Concrete evidence that you must snare Nagato in a genjutsu for him to truly be under a genjutsu in my book.
