I'm certain he had it when he fought The 1st Hokage. As the time frame of when he told Sasuke to when Konoha was made would indicate that Madara did infact have EMS when he fought 1st

But a three tomoe sharingan can't do that so... it has to be at least MS and as we know EMS makes MS eternal... so.... he still has EMS...

one thing is for sure... we don't know if Mandaras right eye is his own or if he was forced to use Izanagi in the past and he transplanted another sharingan in its place. That's what he did with his left eye when he faced konan... and now he replaced that with rinnegan... soo maybe he doesn't have the ems or the ms but is still able to do space/time ninjutsu...
