I mean every Uchiha has in their DNA to awaken Sharingan, Mangekyou Sharigan and Eternal Mangekyou Sharingan, so I don't see why EMS would be considered borrowed power. The Uchiha can simply just swap eyes when both Uchiha has Mangekyou Sharingan.

A Uchiha implanting someone eye is no different than getting a hand transplant by losing in war or implanting organs.

Well you can't borrow someones eyes. Especially if that person is dead.

What if no one died? I mean both Uchiha brother swap eyes not leaving one Uchiha without eyes.

Sasuke is Itachi brother so that how EMS works, if Itachi was alive then he get Sasuke eyes which turns to EMS.

Why would swapping eyes be considered stealing and borrowing? The Uchiha body requires for eye transplant whether they want to or not.

Because to achieve EMS you need the ocular powers of another.

Meaning to gain it you must use/obtain power that is not yours, Meaning it is either Borrowed or stolen power.

Plus i don't believe the process or achieve ems is as simple as swapping eyes.

I don't consider it to be borrowed power since EMS sasuke does not have anything Itachi had for example the Totsuka and Yata or the Tsukuyomi.

Amaterasu and Blaze release was feats that Sasuke's eyes had originally when he awakened the Mangekyou Sharingan after learning the truth about Itachi.

EMS is just a regular MS, the only difference is that EMS doesn't have the side effects from the over usage. Meaning the "eternal light" as Itachi stated.

Yes it does. It's not like a power being borrowed means anything though. It's kinda weird how someone was so desperate to prove the drawing he liked was better than another one, he scraped this excuse of a rhetoric from the bottom of his shoe and now everyone says it like it's a great argument. Who cares if a power is borrowed or not, that won't stop Kabuto from beating Itachi

It's not borrowed and only Indra's reincarnations can get EMS.

It obviously counts as borrowed/stolen powers as it wasn't the persons originally. It can be done willingly by both participants (Literally a free power-up/giveaway) or not. (In which case you just went full Oro/Kabuto.)

Nope..

Only applies to naruto, minato, jiraiya, and jins.

Uchiha such as Madara & Sasuke had no intention nor even the ability to return their brother's eyes.

Both were gifted I'd say, as Itachi's were definitely & we've proof Madara didn't & wouldn't kill his brother(s)... even for power.
