Sasuke summoned manda with near zero chakra. So no it is not a plot hole. This just means toads need more chakra to summon.

Well, his Chakra was low to the point that he couldn't even bring himself to stand up even when he tried, and given how he had to rest for a while after the fight, it's clear he was low. Besides, I don't recall Sasuke denying Deidara's words. And I never said Sasuke was out of Chakra, but low on Chakra.

You're blatantly denying facts. Sasuke directly attributed shocking himself with Lightning to why he was worn out, yet you're still trying to make it about chakra despite multiple other pieces of evidence proving otherwise. That being 1) deactivating his Sharingan because he believed the battle was over, 2) summoning Manda, 3) Orochimaru never breaking free which was established to ONLY happen if Sasuke over exterted himself

Furthermore, if not having any more chakra means the user can't even stand, then he would have collapsed against Itachi.

And even if Sasuke was low on his own chakra, he still had an entire other source of power to draw from. That being Orochimaru. He was basically Orochimaru's Jinchuriki. Except he could tap into Oro's power whenever he wanted. Not needing cooperation like Naruto and Bee.
