Marijuana, unlike what health classes teach you, doesn't really carry any risks. While the smoke is harmful to your lungs when used regularly the active ingredient in marijuana, THC, doesn't really have any negative side effects.
Alcohol on the other hand is a poison. It will make you vomit, pass out, and severely damage important organs like your kidneys when heavily abused.
Also weed is illegal because of the way our country is run - most want it legalized or decriminalized (or flat out don't care) but that won't happen for a few years if it happens. And alcohol is legal because it's such a common day thing, in countries where weed is mostly legal (no one has it totally legalized) they have the same view.
Legalization is a combination of cultural feelings and governmental policies, that varies country to country.
Regarding #5, every atmosphere is a social one if someone else is there (that's just how it is). Honestly, I think what you're meaning to say is that if you're in a situation where you're doing something semi-important, dangerous, or have some form of obligation you shouldn't be using anything that would result in an altered state of mind.

1. You need to specify where it is illegal. Not everyone on this site lives in the United States or other countries where marijuana consumption is illegal.
2. If you drive while high, it is just as deadly as driving while under the influence of alcohol. DUI's are not merely alcohol violations.
3. Alcohol is legal (In the United States) because back in the 1920's they tried this thing called "Prohibition." Even though most areas were dry (Meaning alcohol consumption was prohibited) before Prohibition, it actually created an illicit trade market crime sky-rocketed.
4. The legalization of marijuana is hotly contested because it pretty much never has been legal in the States. Though I personally do not condone either alcohol or marijuana, I have not seen enough of a valid argument to explain why alcohol is legal and why marijuana should not be illegal. They both have pretty much the same effects though Marijuana, depending on the THC levels, can act as both an upper and a downer. If it was legalized, there would be a fair drop in crime, however, it would not be very significant because hardcore drugs are the true root of narcotics problems.
5. They are both equally "dangerous" when combined when abused and combined with activities other than a social atmosphere. Driving Under the Influence of any controlled substance (or anything that impairs your judgment, coordination, reaction speed, etc...) poses a risk on the general public. Marijuana, though illegal, does not have significant punishments attached to it as long as you have only enough for personal consumption. It's when you possess larger quantities that it becomes a real issue.
