He was defeated by Itachi and that started his arc in Naruto where he went searching for the a weaker, fragile and naive Uchiha. I don't think the 3rd wanted to kill Orochimaru as he cared about his former student.

Well, orochimaru might pop up again if Kabuto is near-death, although I suspect an awkward ending like when he popped up in Sasugay vs Itachi.

i personally think that in the final Naruto will save
Sasuke and it will be something like Naruto/Sasuke vs Madara/Orochimaru(kabuto).It's more logical this way Naruto defeating his enemy,Madara and Sasuke a full powered Orochimaru.A 2 v 1 battle like naruto vs madara/sasuke or sasuke/naruto vs madara will be lame

Only time will tell if Orochimaru will is stronger than Kabuto. Kabuto did stated that He is having to fight Orochimaru cells from taking over.
