Why was Nagato unable to access madaras EMS techs even with his eyes

People seem to believe Rinnegan and EMS have the same relationship 3-Tomoe and MS have,but they don't, Rinnegan is a different Dojutsu, so Nagato can't turn off the Rinnegan to go to EMS.

well if you notice, not even madara have switched back to EMS after showing rinnegan.

just like how someone can't go back to 2 tomoe after unlocking 3 tomoe, or going back to MS after unlocking EMS, one can't go back to
EMS once he unlocks rinnegan.

But he cannot turn his Sharingan off, because that is the form in which the eye was in when he received it. Nagato received the eyes in the Rinnegan state. The Rinnegan gives rise to the Rikudō no jutsu, the Mangekyō allows for the high level sharingan techniques. Madara has the power of both but the two dōjutsu are separate. Nagato was given the eyes as a pair of Rinnegan, so he has no Sharingan techniques. He can't 'downgrade' (to the EMS) or turn his Rinnegan off.

2) he didn't even know his eyes were madaras so he never tried to switch

No, they were given in the Rinnegan state. Remember, Kakashi couldn't go back to Obito's normal eye. He could only keep it in the state it was given. He was able to advance it up, but not down. Now, the real question is, if that is the case, then did he have normal eyes and then awaken the Rinnegan, or was it already Rinnegan and it's power was awoken?
