Why did Kabuto cut Itachi?

This is a stupid question. He had a sword, Itachi was attacking him, he attacked. And, if Itachi's soul was still bound to Kabuto, Kabuto could simply dispell him. Itachi's body is dead, but he is no longer bound to Edo. If he dies, he will die.
