You know if you check the manga battle again. Sasuke fought the entire battle. basically. In rinnegan/3T mode. and not Rinnegan/EMS mode. He could have easily had his right eye in EMS mode. No idea why he didn't considering he could do it. That supposed intent to kill is really debatable. If you ask me, he wanted Naruto to stop him.
