Near got a huge help with the fact that Light took over the role of L while Near was his true successor , although Light didn't know about Wammie's House. Near got lots of help from Mello in a way. Kira still could've won after being taken into custody he probably would've been put in the back seat of a cop car and hand cuffed so he could've used the last piece of his Note hidden in his watch. Writing with your hands behind your back doesn't seem that hard.
