I've always just thought he would just return as he hadn't committed any crimes then and naruto would have TNJ him after finding him unconscious post itachi battle but this seems possible too

because there is nothin left and wait for him inside of Konoha except his brotherhood with Naruto, also he is already a missing-nin when he left and join Orochimaru, so it will be very awkward to return to the village just because of his brotherhood :lol
Unless team 7 set out again and persue Sasuke to return back to the village or tell him that they needs more manpower to hunt down Akatsuki....

All i want to say is Sasuke is not the type that will decide to go back to Konoha but he will agree if team 7 asking him to join in again.

Actually, being a missing-nin which was essentially what Sasuke was is a crime, so returning to Konoha isn't an option for him. The only reason Sasuke seemed to be innocent was actually because Tsunade ensured that no one would kill Sasuke or at least take action. If it were anybody else who had been Hokage then Sasuke would've been sought for and potentially killed.

Itachi told Sasuke that he wasn't the only one who took part in the Massacre. Sasuke would go try to kill the one who helped Itachi kill his clan.
