When it said that he was unable to stay in Konoha, I don't think that meant he was legally unable to stay. That probably just meant that his conscious rendered him unable to stay. He probably felt that it would be too weird if he stayed in a village that he was once determined to destroy.

Besides, his wife and daughter live in Konoha and his daughter attends the academy. It wouldn't make sense for Sasuke to be banned.

Plus, let's not forget who the 7th hokage is. Do you really think Naruto would ban Sasuke (or not undo a ban if one was previously established)?
