it would point to the fact that his sharingan is implanted. I doubt you can turn off an implanted (ie stolen) sharingan, since both Kakashi and Danzo cover their Sharingan when not in battle. Activating/deactivating a sharingan may be an ability only born Uchiha can do, which has lead me to believe that Tobi's eyes are stolen and implanted. His right sharingan is always active in the manga (seen through his mask) and we didn't find out his left eye was a sharingan until the fight with Konan. Meaning he could have been covering it to conserve chakra.

This could point to him not being a born Uchiha, but rather one created (blah blah zetsu/clone theory in regards to Tobi)

if it was Obito why would the sharingan always be activated? Why would he hide his other sharingan unless it would give away that he is an Uchiha believed to be dead, or he cannot deactivate him.

edit. Obito would've had to implant eyes since his were stolen. But would he have the ability to turn off an implanted sharingan?

Itachi was also able to keep his sharingan activated the whole time (even if he didn't need it).

He's no ordinary sharingan-user: he has the ability to control the kyuubi (as seen in the manga/anime). He's also an advanced space-time ninjitsu-user. This means that he really masters the power of the sharingan.

It also seems like he has no drawback from keeping his sharingan activated.

So what do I think? He's:
1) A genius with a massive amount of chakra
2) An Uchiha-clan member
3) Both.

tobi is def a senju or and uzumaki and i say uzumaki jus based on the fact that they said the uzumaki were scattered around and the main character is and uzumaki plus i got a theory that the uzumaki are the tr decendants of the sage noot the senju and sumwhere the stories got mixed up and if u would like to read it here is the link

i think tobi is an uzumaki or senju for one big reason no one on the entire show but an uzumaki or a senju could possible have the chakra reserves to control 5 bijuu at once and u could argue well he took senju uzumaki dna but remeber when danzo did that and got near the end of his chakra the senju dna over took him and he couldnt control it anymore but tobi has no trouble at all

also if he took hashi dna like everyone else he would have wood style but he hasnt shown it but what he has shown is the uzumaki kushina chain style there so who he is exactly no one can say but based on a few actions from tobi including the two i mentioned and the final inability to deactivate his sharingan im 99 percent sure he is an uzumaki

feel free to flame i prolly would i know there is holes in every theory but at least i didnt say he is obitio haha

Well Good theory & could be true azwel for him being a Senju but he can't be an Uzumaki though imo. Remember what he said abt Uzumaki's when extracting kybi 4rm Kushina - something regarding spiritual force which surprised him to be true, contradicts him being a Uzumaki.
He does not ve any traits of Uzumaki aswell

hair can be changed or like naruto he jus does not have the red hair but as for him needing senju cells i saying i dont think he personally has any senju cells he uses them for his zetsus and stuff but i when has it been said that he has senju cells himself

i know there are holes like any theory but still the holes can be covered by some small speculation and i know that doesnt really count in the end but when there is no fact sumtimes u need to take sum calculated speculation to form a thought
