In any case how do you know that "Tobi" can't close his eyes? It's not like they've ever shown him asleep :|

yea, kakashi can close his eye, he cover's it so he doesn't have to walk around like he had a stroke all the time.

Hm well while you do have a point, we can't be certain of it just by going by the eye alone. I mean the times we see him, he's either being rather intimidating or he's in a fight ... So maybe he can turn off his Sharingan but he just doesn't want to. I mean Sasuke is walking around with his Sharingan most of the time now if I remember correctly ...

it would point to the fact that his sharingan is implanted. I doubt you can turn off an implanted (ie stolen) sharingan, since both Kakashi and Danzo cover their Sharingan when not in battle. Activating/deactivating a sharingan may be an ability only born Uchiha can do, which has lead me to believe that Tobi's eyes are stolen and implanted. His right sharingan is always active in the manga (seen through his mask) and we didn't find out his left eye was a sharingan until the fight with Konan. Meaning he could have been covering it to conserve chakra.
This could point to him not being a born Uchiha, but rather one created (blah blah zetsu/clone theory in regards to Tobi)
if it was Obito why would the sharingan always be activated? Why would he hide his other sharingan unless it would give away that he is an Uchiha believed to be dead, or he cannot deactivate him.

It's because he's careful. All the space-time techniques comes from his right eye, so it's good to keep it activated just in case. Also the fact that his sharingan is activated all the time, and he doesn't seem to get tired tells something.

well we haven't see his normal eyes, we only see his sharingan in battle. sometimes there's no sign of his eyes at all but we see him moving.

I think Kishi probably made it like that so we cant exactly tell. People before me mentioned before that we ussually see him when he's fighting or when he's trying to scare or intimdate people. And maybe he's just capable enough to keep it on 24/7. But im betting kishi made it like this to keep us guessing.
