and he was dying when he fought Sasuke so it's pointless to judge his stamina on that arc/fight

Why didn't he kill orochimaru?. Itachi is a pacifist who tries his best to avoid confrontation and seek peace.
He doesn't enjoy killing or fighting in general.

He left kakashi in a state of confusion because of this but also sasuke about kabuto, who itachi replied to sasuke he wanted kabuto to acknowledge himself before he dies and this was kabuto who was threatening the shinobi world, but also sasuke's safety and we all know how itachi feels about this.

Yes they couldn't kill kabuto, something itachi stated about 4 times, but it wasn't just because if the user of edo tensei dies the technique stays but also, that is just his personality. After releasing the technique, there was no point in keeping kabuto alive.

Why didnt he seal orochimaru?

That confrontation happened before the series when itachi was roughly 11.
Though we have no idea when he got hold of the totsuka, i would think he got those weapons later on in the manga and not at that present time.

Besides that snake bastard is a very influential character and his demise before the start of the series will have a very great impact. Heck the fool is still having a great impact on the manga as we speak
