and then tobi's task was to recruit the top shinobis for his mission to gather all the tailed beasts. itachi was one at the top of his list.. itachi being top of the elites in konoha. itachi being a double spy at the time was ordered by danzo to annihilate uchiha clan, and then tobi met him to be recruited by that time. itachi asked tobi's help for his "annihilation" mission in exchange of him joining akatsuki, where both has no intention of killing their own innocent clan. tobi then planned on using zetsus acting as real uchiha people which itachi will be "slaughtering". itachi ask to leave sasuke alone in konoha to live normally while the others escape to hiding (until the moon's eye plan is completed - tobi's plan). tobi and madara's plan goes well since then (restore uchiha clan) while itachi didn't see the whole picture of it. madara will be revived sooner as planned. this last ninja war was part of the plan, madara's revival with it but madara was surprised that kabuto joined in and he was resurrected as edo tensie (madara says "things did not go as planned") nevertheless its only a small glitch. orochimaru somehow found out about the uchiha clan's hiding place, that is where oro is taking sasuke, to get his answers.
tobi being confirmed as obito is still the same obito as before. the only difference is his belief of obtaining peace. his idealogy is different. tobi have not killed anyone from konoha with his own hand, as well as itachi, unless someone stands between him and his mission of "peace" (e.g. yahiko told him to get the rinnegan over her dead body). tobi could have killed lots of shinobis including kages during the 5-kage summit including his close up encounters with naruto, kakashi and yamato, tobi could have killed naruto, shino, hinata, kakashi, etc during their meeting while sasuke was fighting itachi, but he did not.
