Why do you insist on ruling that out? It's a perfectly satisfactory explanation that would still allow for the possibility of the sage not having the rinnegan prior to sealing the Juubi. We know Naruto and Kurama can see each other despite the fact that Kurama is sealed within Naruto. What makes the sage/Juubi situation any different?
Personally, I'm neutral on this matter, but assuming the sage had the rinnegan all along, I have to wonder why should the Juubi also have the rinnegan? One or the other, I could understand, but both? It just strikes me as strange.
