Well, that was probably something demanded by the other kages, Kakashi managed to fix the situation, but if it wasn't for him, he most likely would have remained there for a while.

If say Orochimaru, Gato, Hidan or Kakuzu were in Sasuke's position they'd help but that doesn't mean everyone should immediately view them as good guys. So I think that's why he was temporarily in prison. Remember people won't just forget the things he has done and people always tend to hold grudges. But I do think Sasuke deserves to be free.
