The current Madara does not have EMS

Madara's eyes still have their power, the ems is still his, and I'm going to prove it with some manga references.
I will have to take you back a while, but this information was given when itachi and sasuke fought.
first all the way back, itachi killed the uchiha clan and confronted sasuke, he mentioned that if sasuke would awaken the MS that there would be 3 people with it. we see a flashback of this moment in chapter 385 page 2.
now later, at the first moments of the fight of sasuke and itachi when they are still feeling eachother out with genjutsu sasuke poses the question to itachi who the other uchiha with ms is (ignoring kakashi at the moment) , now literly he does say the third uchiha surviver but you know where the question came from, this can be found on chapter 385 page 3
then itachi begins the story of uchiha madara and when he comes to the part where madara and hashirama fought for the title of hokage (on chapter 386 page 10) if you look at the last pannel on that page you can see that it sais "Though he lost the battle for control, he remains alive and well, as do his eye's and their power
that should put an end to that discussion right?
as for why we have not seen it in action, your guess is as good as mine, his current body seems to have an ability to sustain heavy damage and be repaird easely, he slaps on a new arm like we put on a new shirt, so I'm guessing it's the same deal with his eyes now. he addapted rather quick to the rinnegan compared to sasuke and his ems. my guess is that he has his ems eye's somewhere in storage or it's in his original body and he is just controling this tobi body that we see all the time. but as I said, on that part your gess is as good as mine

Madara has the Eternal Mangekyo. However, Madara has stated that it was damaged while he was fighting the First Hokage.
As a result, he probably can't use Tsukiyomi, Amaterasu, or Susano.
I dunno how he would go about getting these abilities back.

How does one physically possess Tsukiyomi, it isn't something you can pick up and hold, it is an ability. One has the power to use Tsukiyomi.
