The second one, maybe not in the manga, but definitely in the anime. The first one definitely is though, with how easily he dispatches Kakashi. But, to list a few more without bothering with scans, let me go ahead..

3. Reveals his six paths to Jiraiya
4. Killing Jiraiya
5. Killing Kakashi
6. Dodging Rasenshuriken.

Also, with the way Madara meet his end...well, I just can't respect him as a badass as much as I do with Pain. Taken from his high pedestal and backstabbed by Zetsu of all people...big fail.

Can't think of a single fail that wasn't compensated on Pain's side however.

He was decent, but his whiny "ma life so hard erhmagawd" attitude annoyed the hell out of me. Subtracted from his overall "badassery". Killing and destroying just because life didn't go your way felt like watching a toddler in his terrible twos kicking and screaming.

Contradicting Naruto, who got on with his with a solid goal in the fashion of his tenacity and strong will.

Yet, he went down like a fodder. He's more of a puppet than Pain, since he didn't even know he was being played until the very end.

Pain, on the other hand, knew Tobi was behind everything and respected that, they were working towards a common goal which he was willing to give his life to even though Tobi was the boss. Plus, he went down fighting, unlike Wankdara over here.

Madara didn't turn into a b-i-tch after he lost his siblings and family, he was raised in the worst war era and kept getting stronger until him and Hashi were the strongest amongst all shinobi.

And if it wasn't for his plan Nagato would've died like a fodder

Honestly Madara was always a loser, his clash of ideal always lose to hashirama and his clan had more loss in his war record against the senju. Even his own clan distrust Madara. Even Madara becomes a powerhouse, he wasn't ruthless enough to kill anyone but some random fodders. Not to mention he got ONESHOT TWICE.
First by Obito and then Black Zetsu.

If you exclude Nagato; Pain itself literally killed almost everyone importance from the leaf village and if you count in the Anime, he also took out Utakata of the 6 tails easily which makes him more of a boss than in the manga given the amount of stake of buildup where's he about to head the leaf village.

It doesn't matter if Nagato followed Obito plan who followed Madara because in the end of the day, they've all been deceived from the start and if it wasn't by BZ, Madara would never started this. The only difference that makes Pain more of a badass is that Madara gets much more of embarrassment defeat countless time especially from someone like BZ who have been betrayed.
