its not ems because madara asked if he would take itachis eyes and sasuke said no.
its mangekyo sharingan, because we had it all wrong, its not kill your best freind its kill someone close to you.(he killed itachi).
and if you llook up the thread different sharingans it explain why i think there are different mangekyo sharingans....
but never has one person in the show has a person have the same mangekyo sharingan.

i dont think that Sasuke got it because Itachi died...
notice the snake that gets burned up by the Amaterasu after Itachi falls down, its got eye markings similar to Orochimaru.
now who could be closer to Sasuke at this point in time than Oro?

and think of it this way, sasuke didnt kill itachi but if he didnt fight itachi itachi would still bealive, so he didnt kill him but he contributd to it....

why would they make an unneccesary lie...
plus everyone in the uchihia clan knows you must kill to get it......
what would the point be to make it all a lie.....
its a cool theory to suggest...
