If we're talking the anime, Kakashi can open the first inner gate if he needs any extra chakra to boost up against the curse mark.

I think this goes to Sasuke though. The curse mark level 2 gave Sasuke so much strength that his sharingan upgraded to 3 tomoe. With both of his sharingan active, it would have almost been like fighting Kakashi in slow motion. Combine that with Sasuke's ridiculously overpowered black chidori and Kakashi's got nothing- the lightning blade can't compete with Sasuke's curse mark enhanced chidori.
