Not a valid argument, jiryia was trying to protect naruto, as opposed to oro who actually fought naruto (although oro wasn't at full power, nowhere near it).

Also as i said in an earlier post, tsunade drugged jiryia so he was FAR below even being at half his power,hence why he fell and got caught by oros attack. xd

(This was all proven and stated in the manga you know U_U).

well that seal was never seen to work on the four tails thats why yamato was sent unlike the last time during the fight with deidara where it was only expected that one or two tails are going to come.
