He's the no.3 of the crew most probably, behind Shiliew and Blackbeard, hence he's close to them in power which means he's comparable and probably stronger than Magellan (considering the timeskip)

And Magellan was stronger than any prisoner in the prison, including the new Shichibukai that f*cked up Zephyr, which means Burgess is more or less on a similar level to Sabo, when using comparisons

It was all improvised. With all the mess happening at Dressrosa
Burgess had any intention to fight fair and square for the mera mera in the Colloseum. He even told Luffy he looked forward to fight him.
I'm dissapointed a bit in him aswell tho, attacking Luffy like that. But oh well he's a pirate afterall and seemingly not the brightest
He probably was like if I can't have the mera no mi I will just settle for anything else.
