That does not make any sense since Itachi said that you must kill the closest person to you to get mangekio sharingan or something like that

Ok first, we don't know how he got it, but Madara didn't look so surprised when he saw it. This means there are other ways (harder, or takes a lot of time or who knows what) to get MS.
Second we don't know if he will get blind because he is not an Uchiha and things change in this situation. He doesn't seem to have any signs of blindness because his MS jutsu, Kamui requires a lot of concentration and focus on one single point, and he hasn't showed any difficulties in using it, by any means, he got better at it.
Third, you get EMS by transplanting another MS eye... So to clear things up , Kakashi has MS (mangekyou sharingan) not EMS (eternal mangekyou sharingan).

Doesnt the person you get it from have to have MS first(pretty sure about that)
and since Obito barely activated his before died i know he didn't.

Logically i think he eventually will go blind in that eye but sense he doesn't spam it in the series like sasuke and itachi did he should have more time.

Uhh, no. As far as I know, Obito jumped and rammed Kakashi out of the way. -- Died for him~ U_U

There are many theorys about how he has attained MS level doujuitsu. But I think I can eliminate the one about rembering Obito and that triggering it. If you read the chapters where Kakashi battles Pain he already has the Kamui dojuitsu technique, and when the Paths of Pain kill him he rembers Obito and his other teammates, saying how he's failed blah blah. Chapters called Kakashi vs Pain I think.
But working logicly isnt the best way to go everyone cant/wont agree on how or why Kakashi got his MS. I have my own theory that kept a thread going for like a week but it was all he said they said blah blah blah it dosent make sense blah blah.

he got the mangekyou when he was fighting with deidara he closed his eyes and started remembering what his father told him about his fate when he opened his eyes he told naruto to stay back and he created it chapter 25
