i'll elaborate then oppose ur statement. not only did orochimaru contend with the 4tails, but he did so without the use of his hands/ninjutsu, and as u said a body that was rejecting him, so it's a feat that deserves more credit than he's given; having said that kakashi has enjoyed the luxury only afforded to the living, and that is character growth. orochimaru is exactly the same as b4 he died, thus no character growth 4 him; however, one could argue in the interest of fairness and give orochimaru a new healthy vessel (not an uchiha ofcourse) hence placing him in his more deadly prime, making the hypothetical battle tip in the great sannin's favor, and by that reasoning i'll leave my vote with orochimaru. otherwise, kakashi has become a real force as of late and he would get my vote on the strength of his intellect, skill, and MS.
