Restrictions: none

Starting Scenario: Jiraiya doesn't start in sage mode instantaneously nor does Kisame fuse with Samaheda right away. Both start in base strength, while Jiraiya has Gamaken summoned and Kisame has Samaheda ready execute his offensive maneuver.

He's in base mode. As the battle goes on he's going to fuse with samehada without absorbing chakra.

Jiraya wins. The sword will not become a rock. Kisame does not have to take the chakra it will only take away sage mode. So kisame will not become a rock. The easiest way to win is to summon a giant frog on kisame's head. He is crushed to death.

Run for 10 minutes? What happens when Kisame makes his ocean? He isn't going to escape Kisame on his terrain. Maybe if he grew fins.
