Deidara defeated Gaara, a kage, so wouldn't that make him Kage level. I even remember Oonoki saying he was next in line to be Tsuchikage.(or something among those lines)

And also, there is no evidence whatsoever that Orochimaru was weakened when he emerged from Sasuke. In fact, the fact that he acted so cocky(cocky enough to take on Itachi and plan to take over Sasuke right after) and was able to assume his strongest form to date gives evidence that he was at his strongest. And despite the fact that he didn't have his arms, he still was Kage level without them.

black zetsu was fight off-screen, if you notice soon as kishi started showing black zetsu, he died

the best thing black zetsu did so far was trip a tired km naruto with a branch lol

The only change in powers that Deidara got after fighting Itachi was that he trained his eyes to resist genjutsu. Which isn't much at all.
