5. He wouldnt have taken the form of such a powerful creature.

Sasukes weakened state had nothing to do with how healthy Orochimaru was revived. Anko wasin a choke hold for 50 chapters but Oro was still fine.

Itachi beat Orochimaru so badly the moment Orochimaru tried to take his or Sasuke's body. True Orochimaru was not going for the killed but Itachi beat Orochimaru in less than ten seconds. Kakashi is a Kage level shinobi and Itachi beat him with ease. Another example is the fact that Obito who soundlessly took on Bee, Naruto, Guy, and Kakashi was afraid of him. He also beat Sasuke but chose not to kill Sasuke. This is the same Sasuke who killed Danzo a Hokage appointee and fought four Kages easily and only lost to Mei and Ooniki

no fool, Orochimaru was is the same condition he as when Sasuke attacked him, if not weaker. As I said he didn't try to avoid the attack being typical Orochimaru and thinking something as a simple sword strike wouldn't faze him. There is no argument about it.

Deidara defeated Gaara, a kage, so wouldn't that make him Kage level. I even remember Oonoki saying he was next in line to be Tsuchikage.(or something among those lines)

And also, there is no evidence whatsoever that Orochimaru was weakened when he emerged from Sasuke. In fact, the fact that he acted so cocky(cocky enough to take on Itachi and plan to take over Sasuke right after) and was able to assume his strongest form to date gives evidence that he was at his strongest. And despite the fact that he didn't have his arms, he still was Kage level without them.
