He carries his headband for sentimental reasons, just like every other missing nin carries around their headbands. Sasuke just isn't working AGAINST the village like most missing nins do. He is working with all the villages to protect against this threat, if he was working solely with Konoha, he would have just told Naruto, and Naruto would relay it to the other villages

He is not a hidden leaf ninja. It's never been stated a missing ninja has been reinstated. He has prerogatives as a ninja allied with all hidden villages.
