Someone has already stated before that Itachi always had his sharingan activated.
But If he wasn't a Uchiha he would have to cover it up similar to what Danzo and Kakashi do, or else it would drain his chakra. But that's not the case with Tobi he has an eye hole in his mask so his eye is never covered.
