Very simple. Judge by the state of the person after the fight =D

It all depends if the scenario is in character or not. If it is in character, they're not going to resort to they're strongest attack at the beginning.

If Gai was facing Kiba, a weaker character, Gai wouldn't go with the 7th gate just its his trump card. He'd go with taijutsu and then if Kiba challenges that taijutsu with a transformation, Gai would perhaps enter the gates. That right there in character is mid-diff. Because Kiba has nothing better than that transformation.

Out of character Gai would just use the gates right away and it would be a low diff fight, because they didn't have to go through that process.

I judge it simply with common sense. Neg difficulty(SM Hashirama vs Vote Sasuke) means a reasonal argument cannot be put up for the other side. Med difficulty means an argument can be put up but in the end we all know who's going to win.(Healthy Itachi vs Hebi Sasuke). High difficulty a battle where it could go either way and arguments for both side are very reasonable and mind changing.(MS Sasuke vs MS Itachi)

According to this logic, shouldn't Itachi lose all the matchups you just listed neg diff because Itachi fans can't come up with any reasonable arguments?

I judge difficultty by the amount of effort needed by a person to defeat his opponent,
examples of fights in the manga

Neg Diff - Pein vs Hinata
Low Diff - Sasori vs Kankuro
Mid Diff - Minato vs Tobi
High Diff - Sasuke vs Danzo
Extreme Diff - Naruto vs Pain

I couldn't think of a better example so here me out. Let's say Sakura is fighting a swordsman, she realizes that direct combat will be ineffective because swords give greater reach in combat then fists and that Byakogou wouldn't heal from cutting her body in half so she decides to punch the ground and is almost successful. If the swordsman were just a tad bit slower, it would be a low difficulty win for Sakura instead. I'd still consider it a high difficulty win though due to the threat level for both parties.

It'd be a low diff win for Sakura IMO because her punching the ground isn't hard, and she received no injuries from the fight.

interesting

a neg diff fight would be like

Hashirama vs Hidan(Neg diff)
Hebi Sasuke vs Sai(Low diff)
Pain vs Jiraiya(Med diff)
Tobirama vs Minato or MS Sasuke vs Itachi(High diff)

however high diff it can most likely go either way i also judge how the winner came out of the fight aswell

Needing your most powerful technique to win doesn't necessarly indicate the level of difficulty. It depends on the level of control you have on this technique

1- If it's a technique you can't pull of when you want but only when you're in a life and death situation for example(but without side effects on the body), but it allows you to win, it's a extreme difficulty fight

2- If it's a technique you can use when you wants, but that takes a drastical toll on your body to the point of leaving you close to death after using it, it's also a extreme difficulty win

3- If it's a technique that takes moderate toll on your body, it's a mid-high difficulty depending on how much toll it takes

4- If it's a technique taking no toll on your body(so you can spam without drawbacks), it's a low difficulty

Judge it based on the jutsu needed to defeat the opponent and the strategy needed to successfully accomplish that particular plan. When doing this you don't simply think of blitz gg, as that's rarely the case, you have to consider every scenario and round out the average.

Ex) Itachi vs Minato:
For genjutsu argument one could say low diff. That's illogical, though it isn't impossible as genjutsu simply requires eye contact within a certain distance. However, Minato has multiple counters. Therefore, setup each scenario mentally and determine how difficult it would be for Itachi to achieve this with each incident and simply average it out.

Did a thread on this once. Though I can't find it.

Neg Diff: The winning character could beat the other on accident/if he didn't even know the other was there (This excludes using your strongest attacks like PS/Chibaku Tensei/Bijudama).
Low Diff: Could beat the adversary in 2-3 moves
Mid Diff: Didn't have to go all out, but had to put a good amount of effort in. The adversary wasn't a push over for the character
High Diff: Had to go all out, but its clear which was the winner.
Extreme Diff: The winner is on the edge of death, could have went the other way very easily.

Low-Mid Diff and Mid-High diff are just inbetween the respective diffs.
