Thank the naruto god's Deva couldn't use it while nagato was at the top of the tower.. or he would kill himself

Deva only ever uses this as a last resort, fortunately he won't get a chance to use it before Jiraiya kills him

In 1, deva wasn't even there for more than half the fight, and he couldn't use it in anyways
the other , Deva was out to capture not kill, andhe had just wasted a shit load of chakra on shinra tensei, and fighting konoha..
the other one was with kabuto controlling him
and kabuto forgot about chibaku tensei , thus his words

It's his strongest technique. Konan was begging him not to use it. He obviously has hardly ever used it. He has to deactivate all of his other paths. It shortens his lifespan(unless that was the chou shinra tensei which is the same deal and even more support for this case). It's a last resort technique. Every battle, especially the Naruto battle proved it. Saying he would start out with Chibaku Tensei is ridiculous.
Exactly, so he wouldn't have used it, it was just Nagato so it's not like it made a difference.
Yeah, he was going up against Kakashi and 3 other Jounin and didn't open up with MS, he was going up against 2 Jinchuriki who casually crap on the other Kage and didn't start with MS, he was going against Kakashi and Naruto and Sakura and Chiyo and didn't start with MS, he was going against Sasuke and didn't start with MS, he's started literally none of his fights with MS and he won't start one random fight with MS just because it's his only chance to win and if he doesn't he loses, deal with it.
Same goes with Pain. He won't magically use Chibaku Tensei at the start of the fight because he'll lose if he doesn't, he never would open up with Chibaku Tensei, period. I am very confident everyone would agree that Pain would never do that when in-character.

The entire fight is fictional, and the debaters use their character jutsu to see who wins ...
I'm saying that because Kabuto was using their poweful techniques, he was controlling them, so if autopilot Nagato used it it doesn't say much for the real one however even he didn't jump to it. It's not too relevant though.
So "killing intent" = "retarded and uses their strongest techniques from the start"? I'm fine with that, regardless Chibaku Tensei takes prep time anyway so Jiraiya throws a Chou Odama Rasengan in his face, drops a boss toad on him then drowns him in his swamp.
