What you claim can be a good theory, but wasn't nagato the 7th pain. Moreover, You don't know the limits of the power of madara with the rinnegan. He is way more experienced than Nagato and way more powerful. He is sure to have a few tricks up his sleeve when it comes to the Rinnegan.

It doesn't matter if Madara is more powerful with the Rinnegan than Nagato, Tobi is the one who is using it to make a new 6 paths of pain, which was the Jinchuuriki. Nagato was the 7th path of pain because he could control life or death which the Rinne Tensei. It just meant that to use that power you have to use the main body that has the Rinnegan, not the corpses. There is no special 7th path of pain that you can use another corpse for. There are 6 paths. Obviously Tobi isn't going to use the weakest tailed beast when he has the 2-7 tails. why would he use the 1 tail? It would obviously be weaker, and since he only can control 6 at a time, obviously he would use the stronger ones.

There is no 7th path, Tobi himself would be the 7th path I guess if you want to get technical since he is the real body with the Rinnegan. So therefore he can't make any more paths, the limit is 6.

Dude a bijju is a bijju no matter how many tails does it has. Ichibi is not weak dude, even if it has 1 tail it still can be used as a weapon of mass destruction.
