Conditions: This is the Gaara that fought Deidara
Restrictions: Chibaku Tensei, Gedo Mazou
Intel: Gaara has all the information SM Naruto had in his fight against Pain. Pain knows everything Deidara knows about Gaara.
Intent: Pain has to capture, Gaara has free reign to kill.

Bonus round: Pain is replaced by Nagato and has the intent to kill, but Gaara is a perfect jin with Shukaku.

How does Pain actually win this though?

Animal Path summons get sealed with sand pyramids. Invisible chamaleon can be detected with sand sensing.
Asura Path missiles simply get blocked by sand, ultimate defense if necessary.
Human path is non-factor
Preta path is non-factor since Madara canonically couldn't absorb Gaara's sand
Naraka path is non-factor pretty much
Deva Path can be sealed or crushed if Gaara takes advantage of the 5 second interval, using the sand under his feet. Gaara's sand is pretty fast.

I am tempted to say that Gaara wins both scenario's considering that Nagato is going to capture Gaara only.

He without a doubt beats Pein because of this. And a perfect Jin. Gaara's a scary thought.

How does a big klutzy bird avoid getting sealed/restrained by sand though? Gaara's dealt with Deidara's bombs, I think he could deal with Asura. And bansho tenin would be suicide since the sand will get to Deva before Gaara will.

How is he dealing with a large bird, and multiple missiles from below at the same time? His only option is to use that sand sphere he did in the Chuunin exams, which is futile because he's a sitting duck for Asura.

Already said Pain just uses Bansho Tennin to pull him out of flight, I really don't see how Gaara counters, not only that but has to deal with more Missile barrage from Asura at the same time if need be.

Bird gets dealt with through massive sand tsunamis.

If Deva uses Bansho Tenin, he gets a face full of sand since Gaara will barrage him with sand bullets or sand shuriken while he's getting pulled toward Deva, and Deva won't be able to deflect them due to the 5 second rule.
