One must remember, that Kishimoto as a writer often retcons himself. What this ultimately leads to in an unfinished work is inconsistences and numerous plot-holes. That in itself should tell you why Orochimaru is able to do perform certain amounts of ninjutsu. Furthermore; I stated in the OP that Orochimaru can use some, but cannot use his complete arsenal of jutsu’s due to sealing of his arms. In addition to this, Kabuto mastered the Edo Tensei to a higher degree then Orochimaru did, which puts him as the focal point of the technique as of now in the story. The fact that Orochimaru retook his chakra back should hint that the story is centering more on Orochimaru then Kabuto and that Edo Tensei is not the focal point anymore. Additionally; Edo Tensei as of now has no seen properties that will enable Orochimaru to summon those trapped in the stomach of the Death God, unless Orochimaru knows something Kabuto did not.
Orochimaru has seen everything that has been happening from within Anko. Ironically he has come back after Itachi has seemingly left for good this time, which means he has seen what happened between the Uchiha’s and Kabuto. He has seen a glimpse of Sasuke’s powers and he himself admits to not being able to take his body, yet profusely because his isn’t strong enough. Orochimaru also may have recently finished the writing contents of the scroll before his untimely death by Sasuke, which would mean that he never actually used at all. However that is only a thought, and until Kishimoto provides us with more information I cannot factually say for sure why he did not use the scroll while alive-I can only speculate on reasons as to why or why not.
