no hes not technically akatsuki. him, jugo, karin and suigetsu were team hebi who were just working with akatsuki for a bit. they arent anymore. now its just that sasuke is with madara.
but my favorite has got to be either deva path, tobi(before we knew of him as madara) or itachi

But as long as he wears the Cloak he symbolizes the Akatsuki. And if that is the path he wishes to take then i got no problem with that. And yes in refferance to sasuke he is part of Akatsuki. Who was talking about Hebi anyway?
