But there is a catch...You don't have it in you to summon any Kage...dead or alive...this includes Gaara..sorry...and I know....Pain and Madara were previous Kage of their villages.. but for this...they are just S-Class Criminal Shinobi...

The bolded part made me believe you can summon anyone no matter if they are alive or not. Also this isn't Edo Tensei so it's more likely that you could summon living people not dead ones.
