Already addressed this. If he really had MS, he would have been blind. It's not the same, period. The Uchiha's MS is a degraded variant of his power, and probably so is EMS. Indra clearly doesn't operate on the same rules as Uchihas.

I don't think the eyes itself are important in that case, but the chakra. We know that the Sharingan is a result of a special chakra which is produced inside the brain. The Mangekyō Sharingan probably too. So the eMS awake (probably) if the chakra of the former and current user are able to merge.

The same goes for the uchiha dude. Not every uchiha awakens the sharingan and even less awaken the MS. And even less so for the EMS as two Uchiba have ever done so. Not every uchiha eye is compatible. You stop.

What the? Onoki asked if Madara is using the Mangekyō Sharingan already, because of Susanoo. The eMS is just a Mangekyō Sharingan. It seems you don't know the meaning of Chuko Tomoe. Again: Sasukes Mangekyo consists of many connections of straight lines. The former Tomoe of the Sharingan changed its basic form into a more complex.

What matters is how they utilize these powers. Basically, we could say he had a Mangekyō without side-effects. In this meaning it would be a eternal Mangekyo Sharingan, sure, but formal the eMS emerges only with a new eye pair.
