But there is proof he hasn't inherited the Rinnegan but a Spiral Type Dojutsu.
He inherited the Eyes, it never showed the Rinnegan it showed the other type of Dojutsu.

This just further proves my point.

Wasn't the Byakugan earlier mentioned to have been greater than the Sharingan? And also the Sharingan may have evolved from the Byakugan.

I'm not gonna read all the responses right now, but we don't yet know why the elder son got a slight mutation of the Rinnegan. Really, there are only 2 possibilities,

1. He got the Rinnegan 100% and the Rinnegan does not require senju DNA to be unlocked... BUT as soon as it was passed to him, it began to degrade and thus looks more like a spiral than the classic Rinnegan.

or

2. He only got the majority of what can be considered the Rinnegan and the full eye can only be unlocked but combining Senju DNA with it.

Considering it is possible to unlock Rinnegan at all, I think its safe to say that the FULL eye does belong to the Uchiha and does not require Senju DNA to unlock it, but we don't know for sure yet.

Seems to me that the best possibility is that the Uchiha did get the Rinnegan but as soon as it was passed down, it began to degrade and eventually resulted in the sharingan.

The rinnegan is not the same as the spiral.

well this is a very nice theory & diagram indeed, but i believe the spiral form is the degraded version of rinnegan. so the diagram should be labelled "downgrade" after rinnegan to the spiral form. reason being: the rinnegan is the up most doujutsu power, then the so6p split that into the body(later evolved into senju) and then the eyes(spiral form but later evolved into sharingan) , so this means the sharingan is deprived senju dna that disables it from evolving in to rinnegan, and the senju body is deprived the sharingan disabling them from achieving the rinnegan doujutsu. my point is that, the spiral form is in fact the same in properties as the current sharingan, but evolution changed its look.
