No matter what the preparations may be for the tool to be used in a fight, it's still a preparation nonetheless meaning restricting Kabuto without doing the same for others is hypocritical. lets say you're walking to school, and you walk down an empty block where its only you and 1 other guy. When you get close to the guy, he says he wants to fight you now (no prep). You says OK (so it a 1v1). So you have to fight with what you have. there is no one to help you (which is the sacrifices because the sacrifices has to be alive)

Most of the time a shinobi of Kabuto's status will never go into a fight unprepared, he's not that dumb, give him more credit then that. Orochimaru went in completely prepared to fight Hiruzen, and used the edo tensei to overwhelm his sensei. In any given situation he would always be prepared to use edo tensei, I mean why wouldn't he?

If you don't accept that then to fight, every ninja needs a sacrifice. Ninja eat, right? Well some living being is sacrificed for nutrition and sustenance.
Take away Kabuto's tool, then you take away all ninja who eat.
