Tobi can't use jutsu because at least one of his arm is made out of Zetsu material. Hand signs don't work.

Zetsu can't use them either and we all know Tobi body parts are made of the white Zetsu. Which probably means he can't use them either.

Tobi has used earth release. Like busting out of the ground, not just phasing through it. But skilled shinobi can do jutsus without handsigns, FYI
